SCHULTHEIS, J.-- Herbert D. Hardesty pleaded guilty to burglary in the second degree. He was sentenced to 14 months confinement. One year after his release, the trial court resentenced him to 22 months confinement with credit for time served. Mr. Hardesty contends double jeopardy principles precluded granting the States motion to modify the sentence. He also urges the court erred in finding he committed fraud by misrepresenting his criminal history at the original sentencing hearing. We detect no error in the trial courts findings, but agree with the first contention and reverse.
