This appeal arises out of an automobile accident that occurred in November of 1961. Antonin Vinicky, a circus performer known professionally as Tony Smaha and hereinafter referred to as Smaha, and his son, Tony Jr., were passengers in a car driven by one Strampe when it left the road and collided with a tree. The jury assessed Strampe's negligence at 100 percent, and no appeal has been taken from that finding. Both Smaha and Tony Jr., sustained injuries. In respect to Smaha, the jury awarded damages for personal injuries in the amount of $19,000. The jury also awarded damages for personal injuries to Tony Jr., in the amount of $2,000. The court answered the questions in the verdict in regard to loss of earnings and medical expenses and assessed those damages at zero. The defendant claims that the personal-injury verdicts were excessive. It also claims that certain medical reports of physicians who were not present at trial were improperly admitted into evidence. In an extensive memorandum opinion the trial Judge reviewed the evidence and concluded that the damages awarded the plaintiffs were not excessive. Accordingly, the defendant's motion for a new trial was denied, and the appeal is from the judgment awarding damages to the plaintiffs. Were the damages awarded to Smaha excessive?
